These terms and conditions apply to The Newsette’s (“Newsette”) referral program (the “Program”). You agree to the following with respect to referring potential candidates for employment with Newsette.
In addition to the terms listed above, Newsette will not be obligated to pay a referral fee for any individual who: (1) applied for employment at Newsette (2) within the preceding twelve (12) months had been referred for employment at Newsette by anyone else, or (3) provides services to the firm on a contract basis either as a direct contractor to the firm or through another company. All referrals are effective for three (3) months. Newsette will not be obligated to pay a referral fee if three (3) months have passed from the date a referral is submitted. By your participation in this Program, you acknowledge that Newsette, at its sole discretion, may decide to obtain the services of a referred individual by way of contract rather than through employment.
In the event that more than one person refers the same candidate to Newsette, payment will be made for the first referral received by Newsette. Newsette will notify you if a hired candidate has already been referred by somebody else. If the person you refer contacts Newsette prior to you emailing your referral submission to Newsette, no referral payment shall be made.
- Participation in the Program. In order to participate in the Program you:
- Must be an individual person (not a business or legal entity), and a legal resident of the United States and at least 18 years old.
- Must submit referrals to careers@thenewsette.com with the subject: “Referral” and the job title. The submission must include the referral's full name, email, phone number, and resume.
- Cannot be part of or affiliated with a staffing agency or consultancy.
- Cannot refer yourself.
- Cannot authorize others to give referrals on your behalf or contract out your participation.
- Must know the referred candidate professionally and/or personally. The candidate must be aware of and agree to your submission.
- May not submit more than one person within a six-month period.
- Are not subject to any contract or obligation that restrict you from referring individuals for employment at Newsette or otherwise participate in the Program.
- Referrals. You may only refer eligible candidates. An eligible candidate must meet all of the following conditions:
- The candidate is personally known to you.
- You believe the candidate meets all of the requirements of the posted position.
- The candidate is not a current or former employee, or contractor, or a family member of a current or previous employee or contractor of Newsette or its affiliates.
- Is not currently in Newsette’s database or has applied to a position at Newsette.
- To your knowledge, is not subject to any restrictions that would prevent the candidate from interviewing or accepting employment at Newsette.
- Referrals Review. Newsette will not be obligated to interview, engage in any discussions (employment or otherwise) or offer employment to any individual; all interviewing, employment, and hiring decisions (and the timing of it) will be at Newsette’s sole discretion.
- Recruitment/Placement Agencies. Newsette does not accept unsolicited resumes from agencies. For avoidance of doubt, we will not pay fees to any third-party agency or firm sending unsolicited resumes. Unsolicited resumes that Newsette receives will be considered property of Newsette.
- Payment of Referral Fee. If you are eligible to participate in the Program pursuant to the terms herein, Newsette will pay you a one-time referral fee of $10,000 (or in such amount otherwise noted) for one (1) and no more than one (1) individual that you refer to Newsette that is hired by Newsette as a full-time employee subject to the additional following conditions:
- Referral remains a fulltime employee for ninety (90) days following their start date.
- Referral is in good standing after the ninety (90) day probation period.
- Referral is still employed at the time the feel is to be paid.

- Taxes. By participating in this Program, you agree that you will be solely responsible for all taxes related to the referral fee. You agree to provide the necessary information required by Newsette to process the payment and the 1099.
- Terms of the Program. Newsette may modify or terminate the Program in its sole discretion without notice. Referral fee payment is at the sole discretion of Newsette. This agreement is governed by New York law. By submitting a referral you agree that Newsete’s liability relating to this Program for any cause of action is the lesser of your actual damages or $1,000.
